By accessing or using Banana AI, including our AI image generation (powered by Nano Banana Pro and Nano Banana 2) and AI video generation (powered by Veo 3 and Veo 3.1) services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Description of Service

Banana AI provides AI-powered creative tools, including:

• AI image generation from text descriptions (Text to Image)
• AI image transformation (Image to Image)
• AI image editing
• AI video generation from text descriptions (Text to Video)
• AI video generation from images (Image to Video)

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without notice.

3. Account and Authentication

Some features may require you to sign in with a Google account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. Acceptable Use

You agree not to use Banana AI to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate content that infringes on the intellectual property rights of others
• Generate deepfakes or misleading content intended to deceive
• Generate content depicting minors in inappropriate situations
• Attempt to reverse-engineer, decompile, or disassemble any part of the service
• Use automated systems or bots to access the service beyond normal usage
• Circumvent any usage limits, rate limits, or access controls
• Resell, redistribute, or sublicense access to the service without authorization

5. Generated Content and Intellectual Property

5.1 Your Content

You retain ownership of the prompts and input images you provide to our service. You are responsible for ensuring you have the right to use any input content.

5.2 AI-Generated Content

Subject to your compliance with these Terms and applicable laws, you may use AI-generated images and videos for personal and commercial purposes. However, AI-generated content may be subject to additional terms from the underlying AI model providers.

5.3 No Guarantee of Uniqueness

Similar prompts may produce similar outputs for different users. We do not guarantee that generated content will be unique or original.

6. Pricing and Payments

Banana AI offers free and paid tiers. Paid plans include monthly subscriptions, annual subscriptions, and one-time credit packs. Prices are subject to change with reasonable notice. Subscription payments are recurring and will auto-renew unless cancelled.

• Subscription fees are billed in advance on a monthly or annual basis
• One-time credit packs are non-refundable once purchased
• Unused subscription credits do not roll over to the next billing period
• We may offer promotional pricing or discounts at our discretion

7. Refund Policy

Subscription plans may be cancelled at any time. Upon cancellation, your access continues until the end of the current billing period. Refunds are generally not provided for partial billing periods. One-time credit pack purchases are final and non-refundable.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages that temporarily affect availability. We are not liable for any losses resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Banana AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the service.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that AI-generated content will be accurate, appropriate, or free from errors.

11. Termination

We reserve the right to suspend or terminate your access to the service at any time, with or without cause, including for violations of these Terms. Upon termination, your right to use the service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on our website. Continued use of the service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Banana AI operates, without regard to conflict of law provisions.
